1. Scope

This Privacy Policy describes how Hathor Studios, LLC (“Hathor Studios,” “Company,” “we,” “us,” or “our”) collects, uses, discloses, stores, and otherwise processes personal information when you visit or use our website and related online services, create an account, sign up for newsletters, opt into SMS or MMS messaging, submit forms, make purchases, subscribe to paid offerings, interact with our content, or otherwise engage with us online (collectively, the “Services”).

This Privacy Policy does not apply to information collected offline except where expressly stated, or to third-party websites, platforms, or services that we do not control, even if linked from our Services.

2. Personal Information We Collect

Depending on how you interact with the Services, we may collect the following categories of personal information:

A. Identifiers and Contact Information

We may collect your name, email address, phone number, mailing address, billing address, account username, company name, and similar identifiers.

B. Account and Transaction Information

We may collect account credentials, purchase history, subscription status, invoices, order details, customer support records, and related commercial information.

C. Payment Information

Payments may be processed by our third-party payment processors. We may receive limited payment-related information such as billing details, payment status, card type, or partial payment identifiers, but we do not necessarily store full payment card numbers.

D. Communications and Form Submissions

We may collect information you provide in contact forms, intake forms, questionnaires, surveys, emails, messages, project inquiries, support requests, reviews, testimonials, and other communications.

E. User Content

We may collect files, media, comments, materials, project assets, and other content you upload, submit, or share through the Services.

We and our vendors may collect information using cookies, pixels, tags, SDKs, scripts, local storage, server logs, and similar technologies for site functionality, analytics, personalization, advertising, measurement, security, and debugging.

H. Inferences

We may draw inferences from the information above regarding your preferences, interests, likely needs, engagement patterns, or customer relationship with us.

I. Sensitive Information

We do not seek to collect sensitive personal information unless reasonably necessary for a disclosed purpose and permitted by law. If we collect sensitive personal information where consent is required, we will obtain consent as required by applicable law.

J. SMS and Mobile Messaging Information

If you opt in to receive SMS or MMS messages from us, we may collect and process your mobile phone number, consent status, date and time of opt-in, source of opt-in, message history, delivery status, carrier-related data, opt-out requests, and related messaging records necessary to operate, document, and administer our text messaging program.

3. Sources of Personal Information

We may collect personal information:

  • automatically from your browser, device, and use of the Services;

  • from payment processors, analytics providers, advertising partners, social media platforms, messaging providers, authentication providers, and other service providers;

  • from affiliates, referral sources, or business partners; and

4. How We Use Personal Information

We may also use personal information to administer SMS and MMS campaigns, send promotional and transactional text messages where you have consented or where otherwise permitted by law, maintain suppression and opt-out lists, verify consent records, and comply with legal obligations related to mobile marketing communications.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

  • service providers and processors that help us host, operate, secure, analyze, market, support, process payments for, or administer the Services;

  • email, CRM, analytics, advertising, retargeting, messaging, and marketing technology vendors;

  • contractors, advisers, accountants, auditors, insurers, lawyers, and other service providers;

  • affiliates or related entities;

  • counterparties involved in a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar transaction;

  • law enforcement, regulators, courts, or other third parties when required by law or reasonably necessary to protect rights, safety, or property; and

  • other parties with your direction or consent.

We may disclose mobile phone numbers, messaging consent records, delivery data, and related SMS program information to messaging platform providers, telecommunications providers, customer support providers, compliance vendors, and other service providers strictly as necessary to operate, administer, monitor, and document our text messaging program.

We do not share mobile phone numbers or SMS opt-in data with third parties for those third parties’ own direct marketing or promotional purposes.

We may also disclose information that has been de-identified or aggregated in a manner that does not reasonably identify you, subject to applicable law.

6. Cookies, Analytics, and Advertising

We use cookies and similar technologies to:

  • remember user preferences and settings;

  • maintain account and session functionality;

  • understand how users interact with the Services;

  • measure the performance of content, campaigns, ads, and text-message sign-up flows;

  • improve the Services; and

  • support advertising, remarketing, attribution, and audience-building activities.

Some of these technologies are operated by third parties. Those third parties may collect information over time and across different websites or services, subject to their own privacy practices.

You may be able to control cookies through your browser settings, device settings, and, where available, our cookie or consent tools. Blocking some cookies may affect site functionality.

7. Sale of Personal Data; Targeted Advertising

We do not sell personal information for money in the ordinary sense. However, depending on how applicable law defines “sale,” and depending on the advertising and analytics tools in use, certain disclosures involving cookies, pixels, identifiers, or audience data may be considered a “sale” of personal data or processing for “targeted advertising” under some U.S. state privacy laws.

Where required by law, you may opt out of:

  • the sale of your personal data;

  • targeted advertising; and

  • profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, if applicable.

8. Universal Opt-Out Signals

Where required by applicable law, we will recognize valid browser-based or device-based opt-out preference signals that are recognized under applicable law for requests to opt out of the sale of personal data and/or targeted advertising for the browser or device, and in some cases the account, associated with that signal.

9. Your Privacy Choices and Rights

Depending on your state of residence and applicable law, you may have the right to:

  • confirm whether we process your personal information;

  • access the personal information we hold about you;

  • correct inaccuracies in your personal information;

  • delete personal information we hold about you;

  • obtain a portable copy of certain personal information;

  • opt out of the sale of personal data;

  • opt out of targeted advertising;

  • opt out of certain profiling activities; and

  • appeal our decision if we deny a privacy rights request.

We may need to verify your identity before acting on your request. We may deny a request where permitted by law, including if we cannot verify your identity or an exception applies.

If we deny your request, you may appeal by emailing melissa@hathorstudios.com with the subject line “Privacy Appeal.” We will review appeals in accordance with applicable law.

If you are a Colorado resident and are dissatisfied with the result of your appeal, you may contact the Colorado Attorney General as permitted by law.

10. Marketing Choices, Including Email and SMS

You may opt out of marketing emails at any time by clicking the unsubscribe link in the email or contacting us at melissa@hathorstudios.com. Even if you opt out of marketing emails, we may still send transactional, relationship, account, billing, support, legal, or service-related communications.

If you opt in to receive marketing text messages from Hathor Studios, you may opt out at any time by replying STOP to any message, or by contacting us at melissa@hathorstudios.com. After you opt out, we may send a final confirmation message. Opting out of marketing texts will not prevent us from sending non-marketing communications that are necessary for transactions, account administration, security, or ongoing services, to the extent permitted by law.

Message frequency may vary. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchase.

We do not share mobile phone numbers or SMS opt-in data with third parties for those third parties’ own direct marketing or promotional purposes. We may share this information with service providers that help us deliver and administer our messaging program.

11. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • provide the Services;

  • maintain your account;

  • complete transactions;

  • comply with legal, tax, accounting, and reporting obligations;

  • resolve disputes;

  • enforce our agreements; and

  • protect against fraud, abuse, or security incidents.

Retention periods vary based on the type of information, our relationship with you, our legal obligations, and operational needs.

12. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, destruction, use, modification, or disclosure. However, no data transmission or storage system is guaranteed to be completely secure, and we cannot guarantee absolute security.

13. Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without authorization required by law. If you believe a child under 13 has provided personal information to us, contact us at melissa@hathorstudios.com and we will take appropriate steps.

Where applicable law provides additional protections for minors, including certain state privacy laws, we will comply with those requirements as they apply to our Services and data practices.

14. Do Not Track

Some browsers offer a “Do Not Track” setting. Because there is no universally accepted standard for traditional Do Not Track signals, we do not necessarily respond to all such signals. However, where required by applicable law, we honor recognized universal opt-out preference signals as described above.

15. Third-Party Sites and Services

The Services may contain links to third-party websites, plug-ins, embedded media, checkout providers, scheduling tools, social media platforms, messaging platforms, and other services. We are not responsible for the privacy, security, or data-handling practices of those third parties. You should review their privacy policies before providing information to them.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted with a revised effective date. Your continued use of the Services after the effective date of an updated Privacy Policy indicates your acknowledgment of the update, to the extent permitted by law.
